The GamePulse.pl platform provides streamers with a technical tool (“GamePulseBot”) enabling the transfer of digital gifts in the form of game keys to viewers.
GamePulse acts solely as:
the funder of gifts, and
the technical operator of the system.
GamePulse is not the organizer of gift transfers, does not conduct promotional or marketing activities on behalf of streamers, and does not decide on gift recipients.
A streamer using the GamePulseBot acts as the Gift Transfer Organizer.
The streamer independently and at their own responsibility:
decides on the gift recipient or transfer mode,
communicates the rules of gift transfers to their community,
ensures compliance with applicable law.
Use of the GamePulseBot requires prior acceptance of these Tool Usage Terms.
Acceptance is performed through the intentional and manual execution of the system command:!gamepulse accept
Until the terms are accepted:
access to gift transfer functionalities is blocked,
system commands related to gift transfers are unavailable.
Acceptance is recorded by the GamePulse system and includes in particular:
the streamer’s account identifier,
the channel name,
the date and time of acceptance,
the applicable version of the terms.
A streamer operating within the territory of the Republic of Poland:
may use only modes that do not involve any element of chance,
may transfer gifts exclusively to explicitly identified recipients.
Modes based on chance are technically unavailable within the territory of the Republic of Poland.
The recipient may be indicated exclusively through the manual execution of a system command by the streamer.
Streamers operating outside the territory of the Republic of Poland may use other gift transfer modes available on the GamePulse platform.
The streamer bears full and sole responsibility for:
the legality of the selected gift transfer mode,
compliance with local laws,
communication of rules to their viewers.
GamePulse does not verify the legality of streamer actions outside Poland and bears no liability for their legal consequences.
The streamer undertakes to:
Not use, within the territory of the Republic of Poland, wording suggesting:
a contest,
a lottery,
a draw,
an element of chance.
Not condition the transfer of a gift upon:
payments,
donations,
subscriptions,
any financial consideration.
Not attempt to circumvent geographic or technical safeguards of the tool.
Not transfer gifts to persons under the age of 13.
Exercise due diligence to ensure that game keys subject to age restrictions (e.g. PEGI 18) are transferred only to persons meeting the applicable age requirements.
The streamer bears full responsibility for actions taken using the GamePulseBot.
GamePulse reserves the right to:
temporarily suspend access to the tool,
permanently block a streamer
in the event of a breach of these terms.
GamePulse bears no responsibility for:
streamer actions,
legal consequences of streamer decisions,
disputes between streamers and viewers.
GamePulse reserves the right to amend these Tool Usage Terms.
In the event of amendments, streamers may be required to re-accept the terms.
Use of the GamePulseBot after acceptance constitutes compliance with these terms.
